Recowise is designed with a privacy-first approach. Audio recordings, transcripts, and AI-generated summaries are stored exclusively on your local device. We only process the minimum amount of personal data necessary to provide our service.
When using Recowise and its associated services, the following categories of data may be processed:

When you use the AI summary feature, transcript data is transmitted to OpenAI, L.L.C., which is based in the United States. This transfer is carried out on the basis of the EU-US Data Privacy Framework (Art. 45 GDPR adequacy decision). OpenAI is certified under this framework.

These Terms of Service ("Terms") govern your use of the Recowise application and associated services (collectively, the "Service"), operated by Sole proprietorship Noah Mandaus, trading as Marsways Digital Services ("we", "us", "our"), Truchsessstrasse 8, 74182 Obersulm-Affaltrach, Germany.
By creating an account, downloading the application, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Recowise is a native macOS application that allows users to:

We reserve the right to change pricing for future subscription periods with at least 30 days' notice. Existing subscriptions will be honored at the price in effect at the time of purchase for the remainder of their current billing period.
To use the Service, you must register an account with a valid email address and a password of at least 6 characters. You are responsible for:

5.1 Billing: Paid subscriptions (Basic, Premium) are billed monthly via PayPal. The Lifetime package is billed as a single payment via PayPal.
5.2 Payment due date: Payment is due immediately upon selecting a paid plan. Access to paid features is granted upon successful payment confirmation from PayPal.
5.3 No automatic renewal: Monthly subscriptions do not auto-renew. When your subscription period expires, your account reverts to the Free plan unless you manually renew.
5.4 Failed payments: If a payment fails, access to paid features will not be granted or will be suspended until payment is completed successfully.
5.5 Price changes: We may adjust prices for future billing periods. Active subscriptions are not affected during their current period.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

7.1 Our property: The Recowise application, its source code, design, branding, and documentation are the intellectual property of Marsways Digital Services. All rights reserved.
7.2 Your content: You retain full ownership of your recordings, transcripts, summaries, and any other content you create using the Service. We claim no rights to your content.
7.3 License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Recowise application on devices you own, in accordance with the plan you have purchased.
AI-generated summaries are produced by third-party AI models (OpenAI) and may contain inaccuracies, omissions, or misinterpretations. Summaries are provided for convenience only and should not be relied upon as a sole record of meeting content. We are not responsible for errors in AI-generated content. Always verify important information against the original recording or transcript.
You are solely responsible for ensuring that your use of Recowise to record meetings complies with all applicable local, national, and international laws. Many jurisdictions require the consent of all parties before recording a conversation. We strongly recommend that you:
We are not liable for any legal consequences arising from your recording activities.
10.1 We are liable without limitation for damages caused by intentional misconduct or gross negligence, as well as for injury to life, body, or health.
10.2 For slight negligence, we are only liable if an essential contractual obligation (cardinal obligation) is breached. In such cases, liability is limited to foreseeable, typically occurring damages.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
12.1 By you: You may delete your account at any time by contacting us at contact@marsways.de. Upon deletion, your account data will be permanently erased within 30 days, subject to legal retention obligations.
12.2 By us: We may suspend or terminate your account immediately if you violate these Terms. In the case of termination for cause, no refund will be provided for the remaining subscription period.
12.3 Effect of termination: Upon account termination, your access to the Service and paid features will cease. Locally stored recordings and transcripts on your Mac are not affected by account termination.
We may update these Terms from time to time. Material changes will be communicated through the app or via email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you may terminate your account before the changes take effect.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic intent of the original.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer within the EU, you also benefit from mandatory consumer protection provisions of your country of residence.
The place of jurisdiction for disputes arising from these Terms is, to the extent legally permissible, Heilbronn, Germany. This does not affect mandatory jurisdictional provisions for consumers.

If you are a consumer (a natural person acting for purposes outside your trade, business, craft, or profession), you have the right to withdraw from any paid subscription or purchase contract within fourteen (14) days without giving any reason.
The withdrawal period expires fourteen days after the day on which the contract is concluded (i.e., the day your payment is successfully processed).
To exercise your right of withdrawal, you must inform us of your decision to withdraw by means of a clear, unambiguous statement. You may do so by any of the following methods:

To meet the withdrawal deadline, it is sufficient that you send the communication regarding the exercise of your right of withdrawal before the withdrawal period expires.
3.1 Refund: If you withdraw from the contract, we shall reimburse all payments received from you without undue delay and in any event no later than fourteen (14) days from the day on which we are informed of your decision to withdraw.
3.2 Refund method: We will carry out the reimbursement using the same means of payment as you used for the initial transaction (PayPal), unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.
3.3 Service access: Upon processing your withdrawal, your subscription will be cancelled and your account will revert to the Free plan. Any recordings and transcripts stored locally on your device will not be affected.
4.1 Monthly subscriptions (Basic and Premium) do not auto-renew. Your subscription is active for the purchased period (one calendar month from purchase date).
4.2 If you do not wish to continue your subscription, simply do not renew it. Your account will automatically revert to the Free plan when the subscription period expires.
4.3 If you wish to cancel your subscription before the end of the current billing period and request a refund, you may exercise your right of withdrawal within the 14-day withdrawal period as described above.
4.4 After the 14-day withdrawal period has passed, cancellation is still possible at any time, but no pro-rata refund will be issued for the remaining days of the current billing period.
5.1 The Lifetime package is a one-time purchase. The 14-day right of withdrawal applies from the date of purchase.
5.2 After the withdrawal period, the Lifetime license is non-refundable.
5.3 The Lifetime license grants access to all Premium features of the current major version of Recowise indefinitely.
